“As the regulatory landscape around packaging continues to evolve, the importance of packaging regulation becomes increasingly clear and presents a phenomenal opportunity for brands to transition to more sustainable packaging solutions.”

What brands need to do about EPR

01

Identify if you are an obligated producer per state

Identify if you are an obligated producer under each state’s EPR program. This assessment is based on various factors including sales regions, revenue, supply chain role, product types, and packaging materials.

02

Register with each state’s PRO

If liable, you must register with the designated Producer Responsibility Organization (PRO). The current sole PRO in Packaging EPR Programs in the US is Circular Action Alliance (CAA).

03

Compile and submit packaging data

Collate and organize required data like sales volumes by product, and packaging format,  materials, and attributes for the reporting period and submit.

04

Assess amount of liability and pay

Pay fees in line with each state's price structure for packaging materials/formats, based on your packaging footprint.

05

Continuous improvement

Improve your packaging recyclability and reduce overall consumption to reduce your EPR fees as eco-modulation fees kick in after Year 1.
